Welcome to The Flying Grape! By booking and participating in a wine tour with us, you acknowledge and agree to the terms and conditions outlined below. These terms are designed to ensure the safety and enjoyment of all participants.
Each tour participant must individually agree to these terms with a digital signature below.
1. Reservations and Payments
A reservation is confirmed only upon receipt of the full deposit. Cancellations made within 7 days of deposit receipt are eligible for a 50% refund. No refunds will be issued for cancellations made more than 7 days after the payment. Subsequent payments are final and non-refundable. The Flying Grape reserves the right to cancel tours due to insufficient bookings or at will. In such cases, a full refund will be provided within 90 days for all payments received.
2. Tour Inclusions and Exclusions
The tour includes ground transportation (i.e., land-only), guided winery visits, and tastings as outlined in your booking confirmation. Some tour payments include wine tasting experiences in the price, and some tours have the guest pay at the winery (because many wineries will waive the tasting fees with a purchase). Meals, additional drinks, personal expenses, or any activities outside the itinerary are not included unless explicitly stated in the booking details.

3. Guest Responsibilities
Guests must be at least 21 years old and provide valid photo identification as requested. Guests are responsible for their own safety and well-being during the tour. This includes acting responsibly when consuming alcohol and adhering to safety instructions provided by tour staff and winery personnel. The Flying Grape reserves the right to refuse participation to any guest deemed intoxicated, disruptive, or posing a safety risk. No refunds will be provided in such cases.
It is the guests responsibility for acquiring travel insurance for unforeseen delays, loss of luggage, etc. It is highly recommended that you purchase private travel insurance.
4. Force Majeure and Acts of God
The Flying Grape shall not be held liable for delays, changes, or cancellations caused by events beyond our control, including but not limited to extreme weather, natural disasters, pandemics, government restrictions, strikes, acts of war, terrorism, or other unforeseen circumstances. In the event of force majeure, The Flying Grape will make reasonable efforts to reschedule the tour or offer alternative arrangements. Refunds may be provided at the sole discretion of The Flying Grape, but are not guaranteed.
5. Liability Waiver
a. General Liability
By participating in the tour, guests acknowledge and accept that wine tours may involve inherent risks, including but not limited to: accidental slips, trips, or falls at wineries or during transportation; reactions to food or beverages, including allergic reactions or alcohol consumption; and potential exposure to environmental hazards such as uneven terrain, gravel paths, or stairs. The Flying Grape, its employees, contractors, and partners shall not be held liable for any injury, illness, loss, or damage sustained by guests during the tour, unless caused by gross negligence on the part of The Flying Grape.
b. Transportation Liability
The Flying Grape provides land transportation as part of the tour. While all vehicles are maintained to high safety standards, The Flying Grape is not responsible for delays, breakdowns, or accidents caused by us, third-party transportation providers, or unforeseeable circumstances.
c. Personal Belongings
Guests are solely responsible for the security of their personal belongings. The Flying Grape is not liable for lost, stolen, or damaged items during the tour, including pickpocketing, theft at wineries or restaurants, or from hotel rooms.
d. Medical and Emergency Situations
Guests are responsible for disclosing any medical conditions, allergies, or special requirements prior to the tour. The Flying Grape is not responsible for providing medical assistance during the tour, but reasonable efforts will be made to assist in emergencies.
6. Changes to Itinerary
The Flying Grape reserves the right to alter the itinerary as needed due to unforeseen circumstances, including but not limited to winery availability, weather conditions, or operational considerations. Guests will be notified of significant changes in advance whenever possible. No adjustment to tour pricing will occur with any changes to the itinerary.
7. Alcohol Consumption and Safety
Guests are encouraged to consume alcohol responsibly. The Flying Grape assumes no responsibility for injuries, illnesses, or accidents caused by excessive alcohol consumption. Any guest who becomes overly intoxicated or poses a safety risk may be removed from the tour without a refund.
8. Photo and Media Release
The Flying Grape may capture photos and videos during the tour for promotional purposes. By participating, you grant permission for your likeness to be used in marketing materials. If you do not wish to be included, please inform us in writing before the tour.
9. Indemnification
Guests agree to indemnify and hold harmless The Flying Grape, its employees, affiliates, and partners from any claims, damages, losses, or expenses arising from their participation in the tour, including but not limited to personal injury, property damage, or third-party claims caused by the guest’s actions.
10. Governing Law and Dispute Resolution
These terms and conditions are governed by the laws of the state in which the tour operates. Any disputes shall be resolved through mediation or arbitration in accordance with local regulations.
